National Treasury Announces Mass Termination of Tenders

The National Treasury has announced the termination of 20 open framework tenders that were advertised in December last year and in March this year for the delivery of various goods and services.
In a circular issued on Tuesday, August 26, Treasury revealed that the tenders were cancelled in line with section 63 of the Public Procurement and Asset Disposal Act of 2015.
The tenders included the supply and delivery of newspapers, agricultural equipment and accessories, timber and timber products, insecticides, chemicals and spraying equipment.
Other goods and services that had been advertised in the tender notice included the supply and delivery of locally assembled tippers, delivery of flags, emblems and carpets, water pumps and professional cleaning services.
The government also cancelled tenders for the supply and delivery of corrosion proofing for roofing, tanks, pools and built surfaces, delivery of paints, distemper and thinners.
“The National Treasury, through the Kenya Procurement and Disposal Agency, on December 10, 2024 and March 11, 2025, advertised for the following framework tenders,” the Treasury announced.
“The tenderers who participated in the tendering process are hereby notified of the termination/cancellation of the underlisted twenty framework tenders,” the notice added.
Meanwhile,Section 63(1) lists several conditions under which an agency can cancel or terminate a tender before it is awarded to an individual or a company.
A tender could be cancelled if a new law has been passed that automatically makes the procurement of the tender impossible or unnecessary.
It could also be cancelled if the technology related to the procurement has become obsolete or significantly upgraded to meet the current technological advancement.
According to the Constitution, the cancellation of the tender must happen before the said tender has been formally issued to a specific bidder. The law also demands that the accounting officer give viable reasons for terminating the tender.
The procuring agency must notify the tender bidders of the termination of the tender advertisement notice within 14 days of the termination of the notice.
