CS Summoned Over Case Tied to Former President

Members of Parliament have summoned Lands Cabinet Secretary Alice Wahome and Principal Secretary Nickson Korir to shed light on the ownership of a land located in Nairobi’s Lower Kabete area.
This is after former Provincial Commissioner Davis Chelogoi called on the National Assembly’s Land Committee to intervene over his alleged eviction from the land, which he claims ownership of.
Appearing before the Committee on Wednesday, August 27, Chelogoi laid claim to the land, whichhe alleges to have acquired through the late former President Daniel Moi.
He alleged that despite attempts to reach out to the Ministry of Lands to resolve the stalemate, his efforts proved futile as the government failed to address his grievances.
“I have gone to the Office of the Director of Public Prosecution (ODPP) to try and tell them my situation. I wanted to ask him to summon the officers,” he stated.
“This Committee is my last hope because I have tried reaching out to all offices, including the Ministry of Lands, to no avail,” Chelogoi added.
To fully address the matter, the Committee announced plans toinvite CS Wahome alongside other senior lands ministry officials, the Directorate of Criminal Investigations (DCI) and the Director of Public Prosecutions (DPP).
“We will take up this matter, and we give you our commitment to invite all those persons you have mentioned. We will go through these papers, and we ask you to share any additional documents,” the MPs told Chelogoi.
The land dispute dates back to 1995, when Chelogoi claims to have taken up ownership of the land, as another claimant also emerged with a separate title deed on the land dating back to 1993.
The dispute has since been before the courts, including a criminal case in which a suspect was charged over alleged forgery of land ownership documents, and which is yet to be concluded.
In July this year, ODPP applied to the courts alleging that on diverse dates between 2020 and 2021, a suspect who was presented before the courts, reportedly attempted to defraud officials at the Ministry of Lands to change the ownership of the parcel.
However, the suspect denied the charges levelled against him, with the case on the Ksh1.35 billion still pending further hearing and determination.
